Thank you for choosing Body & Mind white-label version of MYFITWORLD App. This privacy policy explains how we collect, use, disclose, and safeguard information when you use our white-label fitness application.

MYFITWORLD is the controller of your personal data and is responsible for the processing and storage of your personal data.

We respect your privacy and carefully protect your personal information. In this Personal Data Protection Policy (hereinafter the Policy) we inform you about the personal data we collect from you, for what purposes and on what legal basis, security measures to protect them, persons with whom we share them, the period in which we keep them, as well as Your rights regarding the protection of personal data.

This Policy applies to:

• all users (professional users and exercisers – end users) of our Body & Mind application on the Google Play store and App Store (hereinafter: the Portal and the Application),
• all visitors to our Portal and Application.

BASIC TERMS

Each individual term set forth below has a purpose within this Policy, as set forth in this chapter:

• Personal data means any information, on the basis of which an individual can be determined (this includes, for example, name, surname, e-mail, IP address, telephone number, education, gender, etc.);
• User – means trainers and exercisers, i.e.. persons who create accounts on our platform and application;
• Visitor – means visitors to our quest and application, ie. persons who have not formed accounts on our Platform;
• Processing is the act of collecting, recording, sorting, grouping, or structuring, storing, comparing or modifying, detecting, inspecting, using, discovering by transferring or delivering,
  duplicating, disseminating or otherwise making available, comparing, restricting, deleting or destroying personal data;
• Service – information society service – a place to connect trainers and trainers that will enable trainers to work at a higher level and provide trainees with customized training and personal coaching service with all the statistics and tools wherever they are.

TYPE OF PERSONAL DATA WE COLLECT
The platform collects different data depending on whether you are a user or a visitor of the platform.

1. User-Provided Information.
   We collect this information directly from the user, when creating user accounts and using the services of the Platform and application.

Personal Information: Name and surname, email address, IP addres and phone number.

Account Information: Username, password, photo.

Health and Fitnes Data: Height, Weight, Gender, Age, Medical data (high or low blood pressure, diabetic discus hernia, inguinal hernia, blood pressure, etc. – training goals, and health issues, Profile personal and body metrics data).

2. Information required to pay for services

Payment will be made through the Stripe payment system. Our users will be obliged to https://stripe.com the payment card to their account if they want to use our paid content, and all transactions that will be performed will go through the aforementioned Stripe billing system, which should take all responsibility for billing. 3. Data collected from third parties

Third parties – suppliers – we work with providers (third parties) to help us work, provide, improve, understand, adapt, support and market our services. We use the Google Play Store and App Store to distribute our app. This provider may provide us with information about you in certain situations; for example, it can provide us with reports to help us diagnose and resolve service issues.

Third Party Services (Sharing Your Data Outside a {account) Account) – We have a feature which allows you to share your data via e-mail. – for now only via email.

Creating an account via Google or Facebook – You can also create a user account on our platform and/or application by connecting through your existing accounts on Google or Facebook. Third party social networking platforms are under the control of third parties, ie. other companies. Third parties may collect your information (including your personal information) and place cookies on your computer or device to enable such functions to function properly. Your use of any third-party services (whether social networks or otherwise), including any personal provisions of this Privacy Policy, so please review these third-party documents carefully.

4. Data collected from visitors to the Portal.

The platform and application can receive information (for example, e-mail address or IP address) about a person who is not yet a registered user (“visitor”) for example when a visitor subscribes to the newsletter, when a member invites a “visitor” to visit the site.

PURPOSE OF PROCESSING AND LEGAL BASIS FOR DATA COLLECTION
We use the collected information for the following purposes:

Personalization: To tailor the fitness experience based on user preferences, health goals, and fitness levels.

Communication: To send fitness tips, workout reminders, and updates about the app.

Analytics: To analyze usage patterns, measure app performance, and enhance features.

The platform processes your personal data on the basis of the following legal bases:

• the processing of your personal data is necessary for the fulfillment of the contract which you have accessed, ie. providing our services.
• the processing of your personal data is performed on the basis of your consent for a specific purpose of processing, whereby you have the right to withdraw your consent at any time (more in the Cookie Policy link);
• we have a legitimate interest in the processing of your personal data (when we use your data for marketing purposes, to inform you about our new services).

Data Sharing

We prioritize the privacy and security of your data. We do not sell, trade, or share personally identifiable information except in the following cases:

Service Providers:
We may engage trusted third-party service providers to assist in app operation, analytics, and improvement.

Legal Compliance:
We may disclose information when required by law or to protect our rights, privacy, safety, or property.

Owner of the application: The owner of this white-label application has access to all personal data that this application is collecting.

DATA STORAGE TIME

We retain your information only as long as we need to provide you with the service and fulfill the purposes described in this policy, as long as you have an open user account. When the conditions for retaining this data are no longer met, we delete and remove it from our databases within 30 days.

We can always remove data on your written request. You can always do that by writing an email to our support at igor@body8mind.com and the data will be permanently removed and if you try to sign in to Body & Mind again, you will have to do a sign up as a user, again (as it never happened before).

PROTECTION OF YOUR PERSONAL DATA

The platform protects your data by using the following protection measures:

1. We encrypt and store in a secure cloud your personal information, which is given to us such as phone number, email, IP address. We follow generally accepted industry standards to protect personal data provided to us, both during and after transmission, such as various security technologies and procedures to prevent loss, misuse, unauthorized access, or disclosure of information – for example, we use encryption technology such as SSL-Secure Sockets Layer to protect certain sensitive information such as location data and security of the TLS 1.2 transport layer to encrypt data from application to server. Unfortunately, no method of transmission via the Internet or method of electronic storage is 100% secure. We regularly monitor our systems for possible vulnerabilities and attacks. However, we cannot guarantee the security of any information you send us. Therefore, although we strive to protect your personal information, we cannot guarantee its absolute security.
2. For the security of your personal data, we have adopted appropriate technical and organizational measures, including in particular:

• Regular and efficient updating of software and computer equipment, where we store your personal data,
• protection of access to personal data,
• backup,
• education of employees, who process personal data within their work,
• monitoring and taking appropriate measures in the event of possible security incidents, which prevent or limit the occurrence of damage to personal data.

DATA TRANSFER

We do not share your personal information with third parties, unless specifically stated and to the extent that we obtain your express consent. Body & Mind will not rent or sell your information that may personally identify you to others.

YOUR RIGHTS

Regarding the processing of personal data, you have the following rights, which are described below:

1. Confirmation of whether we are processing your personal data;
2. Access to your personal data;
3. Correction of your personal data in case of error;
4. Deleting your identity data;
5. Interruption of the processing of your personal data;
6. Refusal to process your personal data (withdrawal of consent);
7. Transfer of personal data to another service provider.

SUPERVISOR

The competent body for the protection of personal data is Zdravko Vukić.

RESTRICTION – Children up to 15 years of age can use our services only with the permission of a parent or guardian.

UPDATES TO POLICY

This Policy applies from 2024-02-01. In case of changes, we will inform you in advance. It is considered that you agree with the new version of this Policy, if you continue to use our portal and application, which is determined by this Policy, since the new version of this Policy comes into force.

TERMS OF USE

This document and the Privacy Policy form our rules on the use of the service on the MYFITWORLD platform and application and represent the Terms and conditions for users, the way of user registration, user rights and notifications, the way of providing the service, the way of calculating fees (commission), copyright and related rights, and others issues that are important for the functioning and use of the Internet platform ( further in the text: Rules).

The Rules are a legally binding access agreement between you and MYFITWORLD LLC. This agreement sets out your rights and responsibilities when you use the MYFITWORLD website and other services provided by MYFITWORLD LLC (hereinafter: “Services”), so please read them carefully. By using any of our Services (even if you only browse one of our websites), you agree to these Terms. If you do not agree with the Rules, you cannot use our Services. Any use of the Platform in whole or in any part not in accordance with these Terms of Use will be considered an abuse of the services provided by MYFITWORLD LLC and by violating the Terms and Conditions.

By voluntarily using any segment of the Platform and the Application, the user confirms that he is familiar with and agrees with the Terms and Conditions and the conclusion of this Agreement upon accession.

MYFITWORLD undertakes to provide the Service to Users defined by these Terms and Conditions, in the manner and with the restrictions described in these Terms and Conditions, and in accordance with the applicable regulations of the Republic of Serbia. The Service User undertakes to comply with these Terms and Conditions in all respects when using the Platform. The contracting parties agree that in order to fulfill these obligations, it is necessary that MYFITWORLD LLC collects, processes, and stores personal data of Service Users in accordance with the applicable regulations of the Republic of Serbia, General Data Protection Right (GDPR) and the Privacy Policy, which is available for all Service Users. By accepting these Terms and Conditions, each User confirms that he or she is familiar with and agrees with the Privacy Policy and gives express consent to the collection and processing of data, in the manner described in the Policy.

1. Service provider “MYFITWORLD” is the exclusive property of the Company MYFITWORLD LLC, with its registered office at Makedonska, Street no. 21, ID number: 21544442, Tax number:111810697, entered in the register of the Business Registers Agency of the Republic of Serbia, e-mail: office@myfitworld.net hereinafter “MYFITWORLD” or “Company”, which aims to provide the services specified herein.
2. Description of the platform and service We, the MyFitWorld LLC have a clear vision – to inspire, motivate and support every person that we can, to be physically active and to actively takes care of it’s physical and mental health. MyFitWorld is providing it’s users with a professional approach to fitness, strength & conditioning, sports and corrective exercises, workouts and programs, but also with the professionals themselves, from all over the world, through MFWNet network. We are more than happy to have you as a member of our digital platform and community.
3. Terms of use of our services and platform – Registration When registering on our website www.myfitworld.net, the user contract between you and us is formed after the registration process is fully completed. When registering via mobile apps, the formation of the user contract depends on the rules of the app store supplier (for example Apple, Google, Huawei, etc.). The contract is generally formed when you click on the “Install” field in the relevant app store and, where necessary, enter your password in question. The users of the Platform’s services are considered to be: 1. Visitors; 2. Registered users (individuals or legal entities divided into two groups: Trainers and Trainees). A visitor is a person who accesses the Platform without signing in and registering. Registered users are natural persons and legal entities that register and log in to the Platform, which can be registered as service providers – Professionals and service users – Trainees. Users must be 15 or older to use the Platform. If the persons are minors, they can use the Platform under the supervision of a parent or guardian. Please note that it is mandatory to accept using MyFitWorld mobile aplication on your own responsibility for potential injuries, physical and/or mental illness or even death.

If Trainees have a Trainer supervision of any kind (as if live, online guided, or online mentorship) for physical activity, the responsibility for results or eventual injury, physical or mental illness or disease, or even lethal outcome, is strictly to their agreement (verbal or written), and MyFitWorld Platform (and thus Myfitworld LLC) cannot be considered responsible at any means, for possible negative outcome of that cooperation. To use the services, it is necessary to register the Service User (open a user account), which is free of charge. You can create an account on our application via e-mail address and choose a password. When you create an account via e-mail address, you need to leave us your e-mail address to which you can receive an e-mail to confirm your identity when entering the application. Users are obliged to keep the access password they need to use the Platform at all times, as well as never to reveal it to third parties. If they violate this obligation, the members do so on their own responsibility and bear full responsibility towards the injured parties, for any damage caused by such use of their account.

Registered and logged in User – The Trainer, fitness, wellness, or Sports club (hereinafter: Professional), may place advertisements and offer the provision of their training, and/or nutritional services (hereinafter: advertisement or advertisements), and/or use the electronic messaging system within the Platform for communication with other Service Users. The user of the service may have several registered user accounts.

Registered Service User – Professional accepts the possibility of contact by e-mail or phone number (if one had left this information on the Platform), in order to work with the Trainee, which was the purpose of placing ads, as well as to contact the administration to help and / or answer questions. The user of the service accepts that the content of his ad, ie the text of the ad, photos and/or videos, as well as his/her/it’s contact phone, will be published to the MYFITWORLD application on the App Store, Google Play store, Huawei App Gallery, and as such will be publicly available to all Internet users. Advertisements placed by Service Users must comply with the Rules on Copyright Law. Any advertisement that is not in accordance with this Rules will be deleted, with notification to the User who posted such an advertisement.

Registered User – Professionals are obliged to pay the amount of the fee in the name of commission in accordance with the Price List which is publicly available on the website www.myfitworld.net, and/or on the application on the App Store, Google Play store, Huawei App Gallery. The user-Professional has offered options for buying slots for registered users – Trainees. The user-Professional has the option to link his card to his account and thus pay for the purchased slots.

Registered user – Trainee, can communicate with Professional via e-mail or chat within the MYFITWORLD application, but can also browse the MFWNet, or become a paying user, by subscribing to MyFitWorld PREMIUM account at our website, Section “Features”, subsection “Trainees” – “MyFitWorld PREMIUM”. Paying User – Either Professional or a Trainee can become a paying user. Professional becomes a paying user by adding a third Trainee as a client to his/her/it’s client’s section. Trainee can become a paying user if one wants to get access to MyFitWorld PREMIUM account – in that case, Trainee will subscribe to a monthly or a yearly billing period and use all the benefits that PREMIUM users of the MyFitWorld mobile application have. These benefits are listed in “MyFitWorld PREMIUM” subsection, of “Features – Trainees” section, on www.myfitworld.net. All prices stated include the applicable VAT. Subscription plan, as well as criteria for subscription, and/or price of subscription for both types of users can change – MyFitWorld will inform it’s users about any change in advance, as well as offering an option to cancel subscription and delete account.

All the users of MyFitWorld Platform (web and mobile app) that use free account, have less functionalities available than paying users. Please note that in order to use some of the MyFitWorld Services to the full extent, certain equipment and training tools (such as gym machine, dumbbells or a pull up bar, bench, etc.) may be required. These are not part of the MyFitWorld Services and need to be provided or purchased by you separately, at your own costs.

When you change your subscription (e.g. in the form of an upgrade), MyFitWorld or the respective store provider (e.g. Apple) ends your existing subscription (hereafter “original subscription” and your newly selected subscription (hereafter “updated subscription”) begins immediately and is active for the time period you selected. If by any chance you decide that you have made a mistake for the subscription plan, you can write directly to our support at support@myfitworld.net and ask for help or a change in a subscription plan, and MYFITWORLD LLC will take that into consideration. Note that MYFITWORLD LLC is not in an obligation to appreciate your request if there is a chance that you have already used a significant number of benefits and/or time for chosen subscription plan. For any upgrade or downgrade of your subscription plan, you will only be charged (or bonused) for the difference between the two amounts for the updated subscription. Your subscription plan will renew automatically for the same period as the original subscription, unless you change or cancel your subscription plan on MyFitWorld website, or by contacting our support, before the current subscription plan ends.

In order to avoid any misunderstanding, please note that the term of a subscription is determined by calendar and is independent from your use or extent of your use of the respective MyFitWorld Service. If the subscription is renewed automatically, the fee is collected in advance at the start of the relevant renewal period.

We reserve the right to assert further claims for late payments.

3.1. Withdrawal and Refund Policy If you have entered a subscription contract for use of MyFitWorld/MyFitWorld Services, you lose right to withdraw the payment by that moment. Please note that there is a realistic possibility of photoshooting and/or filming your PREMIUM content, and/or using benefits that MyFitWorld PREMIUM account gives, from the moment you entered the subscription plan, so that it could result with an abuse of MyFitWorld PREMIUM account by you. In order to prevent potential abuse of MyFitWorld PREMIUM account, we give you the chance to use the MyFitWorld Platform for free, and to inform about all the features and benefits of MyFitWorld PREMIUM account, at our website, or by contacting support@myfitworld.net. In that manner, there is no chance of not knowing what to expect from MyFitWorld PREMIUM account prior subscription. You can always request a withdraw in a written form to support@myfitworld.net, and state the reason(s) and evidence(s) for such decision, and MYFITWORLD LLC will take that into consideration, and will give concrete answer in no more than 7 working days, after reading your request. Refunds are possible if there are technical problems of using the application, for more than 30 working days, and the technical problems are related to MYFITWORLD LLC.

4. Rules for using the Platform Our Platform allows Professionals, as registered users, to post, link, store, share and otherwise make available certain information, text, graphics, video or other material related to various training and nutrition programs (hereinafter: “Content”). All content and information left by users on the Platform must be true and correct. The responsibility for the truthfulness and accuracy of the entered content lies exclusively with the users who entered the same content. We may, but have no obligation to monitor, edit or move content that we believe is illegal, offensive, threatening, defamatory, pornographic or otherwise inappropriate or infringes the intellectual property rights or these Terms and Conditions. You agree that your content and data will not infringe any rights of any third party, including copyrights, trademarks, privacy, personality or other personal or private rights.

Our Services may contain links to third party sites or services that we do not own or control (for example, links to Ipay, PayPal, Payoneer, Stripe, etc.). You may need to use a third-party product or service to use some of our services (such as a compatible mobile web browser). When you access these third-party services, you do so at your own risk. Third parties may require you to accept their Terms and Conditions. MYFITWORLD LLC is not a party to these agreements, they are exclusively between you and a third party.

5. Illegal activities Service users agree that they will respect the following restrictions when using the Platform: 1. It is not allowed to place ads or content that are in any way contrary to the provisions of applicable law or these Rules. 2. It is not permitted to place advertisements or content that are in conflict with any other legal or by-law provisions, if they provide for the obligation to obtain prior or subsequent permission or approval to provide services that are advertised through the platform. 3. It is not allowed to place advertisements that contain untruths and lies, which can mislead anyone, insult anyone, harm anyone, and use anyone’s gullibility. 4. It is not allowed to place advertisements or content that directly or indirectly advertise services related to: pirated copies of products, internet orders, digital distribution and purchase of games and other virtual goods (cryptocurrencies, etc.), pyrotechnics, medical or medical alternative procedures and methods, quackery, narcotics and their use, sexual aids, weapons and ammunition, including copies, starting pistols and air guns, then tobacco and tobacco products (including electronic cigarettes) and their consumption, and alcoholic beverages and their consumption. 5. It is not allowed to place ads or content with political content. 6. Advertising is not permitted for the advertising of prostitution and pornographic content, as well as gambling. 7. Advertising in the form of a public address or proclamation is not allowed through advertisements. 8. Advertising of medicines, medicinal preparations and supplements or the way of their use is not allowed through advertisements. 9. It is not allowed for you to attempt to buy, sell, or transfer any aspect of your account (including your username) or solicit, collect, or use login credentials of other users. 10. It is not allowed for you to post private or confidential information or do anything that violates someone else’s rights, including intellectual property. 11. It is not allowed for you to use a domain name or URL in your username without our prior written consent.

You further agree that your content will not contain defamatory or otherwise illegal, offensive material, or that it contains any computer virus or other malicious software, which could in any way affect the operation of the platform or any linked website. You may not use a fake email address, pretend to be anyone other than yourself, or otherwise mislead us or third parties about the origin of any content. You are solely responsible for all content and its accuracy. We do not assume any responsibility and assume no responsibility for any content posted by you or any third party.

6. Exclusion of liability MYFITWORLD LLC excludes its own responsibility in accordance with the following:
   
   – MYFITWORLD LLC is not responsible for the content of electronic messages exchanged by users using the messaging system within MYFITWORLD LLC. – MYFITWORLD LLC is not responsible for the content of data stored in the database and/or published on MYFITWORLD LLC. – MYFITWORLD LLC is not responsible for the content on other portals in the event that Service Users insert links to those other portals in their advertisements or messages. – MYFITWORLD LLC is not obliged to review the data stored, transmitted or made available, or to examine the circumstances that would indicate the inadmissible actions of service users.

To the fullest extent permitted by law, neither MYFITWORLD LLC nor our employees or directors shall be liable for any lost profits or income, or for any cause-and-effect, incidental, indirect, special or damages arising out of or in connection with the Services or these Rules and User Agreement. In no event shall the total value of MYFITWORLD LLC’s liability for any damage exceed the amount you have paid to MYFITWORLD LLC in the past twelve months.

Due to force majeure or technical problems, it is possible that the Platform and/or the application is not available to all or some part of the users during certain periods of time. In such cases, MYFITWORLD LLC is not liable for any damage incurred. MYFITWORLD LLC reserves the right to refuse to publish advertisements or content for any reason, and in that case is not liable for any damage caused by this act.

To contact the user services of MYFITWORLD LLC (administration), users are referred to the contact form. The response of the administrator or user team of MYFITWORLD LLC does not necessarily reflect the position of the company, and accordingly Users cannot exercise any rights based on such written correspondence. It is not permitted to publish any written correspondence of the MYFITWORLD LLC user team with the User without the written permission of MYFITWORLD LLC or its authorized person.

MYFITWORLD LLC do not control what people and others say or do, and we are not responsible fo their (or your) actions of conduct (whether online or offline) or content (including unlawful of objectionable content).

Medical warning USE OF THE MYFITWORLD SERVICES IS AT YOUR OWN RISK. THE USER IS RESPONSIBLE TO TAKE ALL NECESSARY PRECAUTIONS IN RESPECT OF HIS HEALTH CONDITION AND PHYSICAL ABILITY TO MONITOR THE EXERCISE AND TRAINING PROGRAMS OFFERED ON THE WEB AND MOBILE PLATFROM. USERS MUST CONSULT A DOCTOR BEFORE THEY START USING THE EXERCISE PROGRAM AND NUTRITION PLAN. IF YOU HAVE KNOWLEDGE OF ANY PRE-EXISTING MEDICAL CONDITIONS, WE ADVISE YOU TO SEEK MEDICAL ADVICE FROM A DOCTOR URGENTLY BEFORE YOU START THE MYFITWORLD SERVICES (SUCH AS EXERCISES, WORKOUTS, PROGRAMS OR COACHINGS).

The services and information offered by MyFitWorld and the MyFitWorld Services do not constitute medical advice or a doctor’s advice. Nor are they a substitute for a medical examination or treatment by a doctor.

Users therefore accepting these Terms and Conditions, declare that they have no medical contraindications in connection with engaging in any physical activity, and in particular in relation to:

(a) Family history: – myocardial infarction (heart attack) – cardiovascular stroke (stroke) – sudden death (60 years ago for women, 50 years ago for men).

(b) Their health and physical condition: – if they smoke (or quit less than two years ago) – if they are ex-smokers (if they quit more than two years ago) – if they have high blood pressure – if they have high cholesterol – if they have diabetes – if they are taking any medication for the heart and arteries – if they feel, when they make any physical effort either in everyday life, or when they do sports: – Chest pain – palpitations – feeling uncomfortable or dizzy – any shortness of breath during daily physical activity.

(c) Physical pathologies: – problems with any joints, tendons or ligaments, shoulders, neck, wrists, elbows, hips, knees, or ligaments – any foot problems – any back problems, such as sciatica, discus or others – any other pathology that could be considered a contraindication to engaging in sports activity.

MYFITWORLD LLC shall not be liable for any direct or indirect damage to health or injury resulting from the use of training plans and/or nutrition plans available on the Platform/Application or when the violation occurred due to non-compliance with the Terms of Use of this Platform/Application.

Age Restriction Parents or legal guardians of minors acknowledge that they understand that a particular Training and Nutrition Plan available on the Platform/Application proves to be inappropriate for their age. Therefore, parents or guardians are obliged to supervise the minor when using the services available on this Platform/Application.

Parents or guardians are informed that they may at any time indicate their refusal to process the personal data of minors and publish their pictures, by sending an e-mail to the following address support@myfitworld.net.

7. Billing and Refund Our billing methodology, data collection and policy is in accordance with our payment processor’s terms of use and privacy policy (“Stripe” Inc. 510 Townsend Street, SF, CA 94103, USA). Refunds are possible in case of inability to access the content of the platform due to technical difficulties, lasting longer than 30 working days. All payments will be made in EUR. For all information regarding the methods and procedures of payment, as well as possible complaints, you can contact us at the e-mail address: support@myfitworld.net.

8. Copyright MYFITWORLD has the exclusive copyright and intellectual property rights on the Platform, including all individual elements: textual, audio and video content, visual identity, program code, databases and other elements of the Platform where the author is MYFITWORLD LLC. Any unauthorized use of the Platform, the Application or any of its elements without the written consent of MYFITWORLD LLC as the holder of the exclusive copyright, is considered a copyright infringement of MYFITWORLD LLC.

MYFITWORLD LLC is the sole proprietor of the MYFITWORLD trademark.

The Platform may also contain elements on which exclusive copyrights, trademarks and other intellectual property rights have other persons, who have sole responsibility for the content on which they are holders of these rights, regardless of the fact that the content is on the Platform. MYFITWORLD LLC has sole responsibility for the copyrighted content. The User is independently responsible for the content that is his author’s work, ie for the content that is posted on the Platform. The user of the service, Trainer, reserves the copyright to the individual text and photos of their ads. By accepting these Terms and Conditions, the Service User gives his irrevocable consent that MYFITWORLD LLC may use his/her content posted on the Platform, for marketing and advertising purposes, as well as each of the photos he/she submits when placing the ad, MYFITWORLD LLC can process, the dimensions of photos and videos, and for their aesthetic fit into the look of the pages at www.myfitworld.net.

MYFITWORLD LLC guarantees that “MYFITWORLD” platform, is not OPEN-SOURCE SOFTWARE – source code available with a license in which the copyright owner grants the right to study, modify and distribute the software to anyone without a license fee (ie a demanding license) a license fee is paid.

The MYFITWORLD platform contains only the following SOFTWARE OPEN SOURCE: -Node.js, React, React native, TypeScript.

9. Terms of contract termination Termination by the User. You can terminate your account with MYFITWORLD Platforms/Applications at any time from your settings. You can find more information on the Settings page on the app. Deleting your account will delete all your personal information. However, this will not affect previously created log files and files that you have posted through the Services prior to completion, which will be used, in a pseudonymized manner for general user statistics.

Termination by MYFITWORLD LLC. We may exclude or delete your account (and any associated accounts) and your access to the Services and Platforms at any time, for any reason, and without notice. If we do so, it is important to understand that you do not have a contractual or legal right to continue to use our services. MYFITWORLD LLC may refuse to provide services to anyone, at any time, for any reason.

Cessation of services. MYFITWORLD LLC reserves the right to change, suspend or terminate any service at any time, for any reason. We will not be liable to you for the effect that any changes to the Services may have on you.

Validity of the Rules. The Rules will remain in effect even after you stop accessing the Service or stop using the Service.

10. Rules of Jurisdiction If MYFITWORLD LLC is to be sued for something you did (and we really hope that doesn’t happen), you agree to get involved in our defense, as well as to let us know about the potential lawsuit in a timely manner. This means that you will be involved in the defense of MYFITWORLD LLC (including all our employees, directors and/or Board members) and that you will bear all costs (including reasonable costs of lawyers) and pay all fees arising from your actions, your use (or abuse) of our services, Your breach of Agreement, Terms and Conditions, Privacy Policy.

In the event of any dispute between you and MYFITWORLD LLC the law of the Republic of Serbia and the locally competent court in the Republic of Serbia shall have jurisdiction. By using our Services, you agree that in the event of a dispute, we will try to resolve the dispute amicably through mediation.

11. Other MYFITWORLD LLC may at any time amend these Terms and Conditions by updating this text. You will automatically be bound by the new Terms and Conditions contained in the changes, and for that reason you should periodically visit this page to familiarize yourself with the currently applicable Terms and Conditions. You are allowed to disagree with our Terms and Conditions, and not to be bound by it, but in that case, you will have to stop further usage of MyFitWorld application, to sign out and/or delete your account.
